Guide RC4110
provides information to determine whether a worker is an
employee or self-employed including:
Step 1
- CRA asks what the intent was and whether
they intended to enter into a contract of service
(employer-employee relationship) or a contact for services
(business relationship). Sometimes the intention is
clear through a Written Agreement however, this
status must be reflected in the actual terms
and conditions of the employment.
Step 2
- CRA asks questions to determine the working
relationship such as the level of control
the payer has over the worker, whether the worker provides
tools and equipment,
whether the worker can subcontract the work or
hire assistants, the degree of financial risk
taken by the worker, the degree of responsibility
for investment and management held by the worker, the worker’s
opportunity for profit, and other relevant factors
such as written contracts.
